Why You Should Never Speak to Police Before Consulting a Lawyer in a Child Porn Case

Being contacted by law enforcement about a child pornography investigation is frightening. You may feel pressure to explain yourself or cooperate to avoid suspicion. But in Washington, the most important decision you can make is to stay silent until you speak with a lawyer.

Police Are Not Neutral Investigators

When officers contact you, they likely already suspect you of a crime. They may already have a search warrant, digital evidence, or internet activity linked to your devices. Their goal is to gather more evidence, often in the form of your own words. What you say can be misinterpreted or taken out of context.

Even Innocent Explanations Can Hurt You

People under investigation often believe they can explain away a misunderstanding or show that they did not knowingly download or share anything illegal. Unfortunately, these attempts to cooperate often give police and prosecutors more material to use in court.

Statements like “I didn’t mean to click that” or “I deleted it right away” can be seen as admissions. Even technical language or expressions of confusion may be twisted to imply guilt.

You Have the Right to Stay Silent

The Fifth Amendment protects you from being forced to incriminate yourself. You are not required to answer questions from law enforcement. Instead, clearly state that you will not speak without an attorney and then stop talking.

The Stakes Are Extremely High

Child pornography charges carry severe penalties, including prison time, mandatory sex offender registration, and restrictions on where you can live and work. Convictions can destroy reputations and relationships permanently.

Act Fast to Protect Yourself

Do not agree to an interview. Do not consent to a search without legal advice. And do not assume your cooperation will make the case go away.
