Why Expert Witnesses Matter in DUI Crash Defense Cases

When a Washington DUI charge is tied to a traffic accident, especially one involving injuries or major property damage, the legal consequences grow quickly. Prosecutors often assume the driver’s impairment caused the crash, but this isn’t always true. 

Expert witnesses are often the key to presenting a different version of events that challenge the assumption, so let’s talk a bit about the different types of experts that might be called on to help.

Types of Experts Commonly Used

Accident Reconstructionists analyze physical evidence like skid marks, vehicle damage, and road conditions to determine how the crash happened. Their findings can help prove that the other driver was at fault or that the accident was unavoidable, regardless of impairment.

Toxicologists assess how alcohol or drugs affect the body over time. They can testify about BAC (blood alcohol concentration) at the actual time of driving, not just at the time of testing. This is especially important if there was a delay in testing, as alcohol levels can rise or fall quickly.

Medical Experts evaluate health conditions that may mimic the signs of impairment. For example, diabetes, neurological disorders, or anxiety can cause slurred speech, unsteadiness, or confusion—symptoms often interpreted as intoxication.

How Expert Testimony Strengthens a Case

Prosecutors rely on evidence that can seem convincing—field sobriety test results, officer observations, and breath test readings. But these can be challenged. Experts offer science-based explanations for how those results might be misleading or inaccurate.

For example, a toxicologist might explain that your BAC was rising after you stopped drinking and was below 0.08 when you were actually driving. An accident reconstructionist might show that the crash would have occurred even if you had been completely sober.

In cases involving injuries, expert testimony may be the only way to avoid felony charges such as vehicular assault. 

Experts can introduce reasonable doubt, which is enough to avoid conviction. They can also influence plea negotiations, encouraging the prosecutor to reduce or drop charges.
